A Guide to Spanish Inheritance tax,

IMPORTANT ANNOUNCEMENT

You may be aware of this already, but it’s something many people who own property in Spain don’t know.

It’s about the taxes payable when an owner of property in Spain passes away.

If you have ever wondered about the details of inheritance tax, it’s simply this:

Your hard earned legacy may have to be sold off to pay crippling tax bills when you pass away?

Spanish Inheritance tax, death duties , legal fees - up to 40% .

So, right now, can you be absolutely sure that those you leave behind will have the money to cover those costs?

Of course we would all prefer our children and grandchildren to enjoy the property we’ve worked so hard to own, and not be forced to sell it to cover onerous tax demands.

Equally as worrying, did you know that in the UK system of IHT, a husband or wife is usually an exempt beneficiary?

But in the Spanish system...

Your husband or wife will not be exempt from Spanish Inheritance Tax.

It's a sobering thought, isn't it?

I was advised that the Valencian Community was protected from paying this onerous tax when passed to the Spouse of a departed Husband/Wife.so long as they met certain criteria.Are you saying this is not so.

Are you saying this tax is payable by people with residencia in Spain. A widow I know said she did not have to pay inheritance tax. I also understood you were exempt if you were over 65? It would be more helpful if people were told how much they have to pay, what you seem to be saying is that you have to scrimp and scrape so you can afford to die.!!!!!!!!!!!!!!!!!!!!!!!!

Hello Alan & Gloria,

If both Husband & Wife are full Tax Resident of Valencia Region when one passes away then it is possible that they may only have to pay 1% of the value of asset when inheriting. Unfortunately some owners have been Resident of Spain and move back to the UK for health reasons and when one passes away they have been back in the UK for more than 6 months so have forfeited their Valencia advantages. For Residents of Spain who are no longer Resident of Spain when they inherit, or their children, or beneficiaries who are not Resident of Spain are Taxed by the central Tax office of Madrid so the Regional laws are irrelevant which is where the big problem is.

Please make note that the advantage for being Resident of Spain and over 65 refers to Capital Gains Tax and not Spanish inheritance Tax. Capital Gains Tax in Spain is currently 19% and is charged on the profit on the sale of a property. ENERGY COSTS GOING UP AGAIN

Anouncement on the news today that Electricity and Gas prices will be going up from the 1st of August in the UK. The increases are 10% and 19% respectively and the talk is about how many pensioners will struggle to to keep up with payments and some having to make a choice with either heating or eating. What a sad state of affairs, what is the world coming to????

I have just had some friends contact me from the U.K who do not thing that they will be able to pay their bills next winter and because of this they are thinking of leaving England and coming to live in Spain, AS you say what a sad state of affairs.

That was one of the reasons why we came to Spain to live. Cannot believe how these companies keep putting the prices up when their profits are sky high. I think you are right there will be more people wanting to leave the UK.

But its the same in Spain now, I came here to live in 2003 and I was amazed at how cheap it was, from food to power bills not to mention the cost of petrol, but now its a different story. I had family over for a month not so long ago and they were shocked at how quickly there money went on the day to day things, and were even saying at one point that it was cheaper to live in the U.K not correct I am sure. One thing that they did point out that does cost us a lot more here than in the U.K is our life style, and how much we spend on going out and eating out, yes I know its choice but it is apart of live in Spain to go out a lot and mix with the other xpats, with out it life is very hard. And if you look at it we do go out a lot more than we would in the U.K, we often spend 5 euros on a breakfast or 10 euros+ each on a bit to eat in the evening, this is a lot when you think its almost 1 to 1 with the £ a simple meal for 2 and a few drinks in one of the many places we have is 30 euros, thats a lot. And if you think how many places we have in a small area to eat that always seem to have customers shows that we are all doing it.

So in a way I do think its cheaper to live day to day in the U.K.

That's not counting the cost of property of course

Hi Charly,
I do agree with a lot of what you say, that everything has gone up over the last few years. In particular electricity has gone up by more than 50% in the last 4 years. I remember when I was almost boasting to my family back in England when my Electric bill used to be 15 euros a month, but now the average household is paying anything between 80 - 150 euros pm. Again petrol has risen to almost equal the amount and yes you are right food is also a lot closer in price than before. Having said all of that you have to remember that council tax in the UK is on average between 5-10 times higher than in Spain. (Massive saving)
In terms of eating out, you do tend to go out more here as that is one of the reasons why we live here, and it is also the culture and custom of living in Spain, along with the lovely weather.
Eating out can be expensive, however there are numerous eating establishments where you can have a menu del dia/noche at a set price of around 5-10 euros per person, which includes 3 courses and a drink, so you can have a decent meal for 2 for only 10-20 euros.
I think its swings and roundabouts and we all have to make our own decisions on where we feel we can afford to live and where we really want to live.
We personally still love it here and will continue to live here as we cannot see ourselves going back to the UK, but you can never say never.

GOING HOME

GOING HOME

WE were thinking of going back to the U.K as we are missing the family to much but when we sat down and worked out the costs involved we found that it was going to be impossible. My heart goes out to all of the people back home who are going to be paying so much more for day to day living. I now think Spain is a far better option.

Benijofar

What amazes me is that there are so many people who have gone back to the UK and so many houses sat here empty (no idea whether theyve been repossessed or are just left empty if maybe there is no mortgage on them) but when you want to rent there is nothing around....Surely it would be better to have someone living in the house than it sat empty? We have been looking for somewhere in the Benimar area and there is virtually nothing but when you drive round the area there are so many houses that looked unlived in. Where are the owners of these houses?

Hi, I do know about your house but think it is on Monte Azul which is a bit far out for us - we are looking for somewhere in Benijofar village or Benimar as we have 2 children who walk to Benijofar or Rojales to meet their friends. Thanks anyway.
